1. Agreement to Terms

By accessing or using MimicPhoto's services, including our AI-powered photo editing tools, you agree to be bound by these Terms of Service. If you disagree with any part of these terms, you may not access our services.

2. Service Description

MimicPhoto provides AI-powered photo and video editing services, including but not limited to:

  • LivePortrait video generation
  • Face editing and transformation
  • Background replacement
  • Video generation tools
  • Image creation and text-to-image generation
  • Image and video upscaling and enhancement

3. User Accounts

When creating an account, you agree to:

  • Provide accurate and complete information
  • Maintain the security of your account credentials
  • Promptly update your account information as needed
  • Accept responsibility for all activities under your account

4. Credits and Payments

Our service operates on a credit-based system:

  • Credits must be purchased to use certain features
  • Credit costs vary by feature (e.g., 3 credits per second for LivePortrait)
  • Credits are non-refundable once used
  • We reserve the right to modify credit pricing

5. Content Standards and Prohibited Categories

These acceptable-use rules apply to every MimicPhoto tool, including image creation, text-to-image generation, editing, upscaling, and video generation. They cover prompts, uploaded or reference materials, generated outputs, and content shared through the service. You must not create, upload, request, process, or distribute any of the following:

  • Sexual or NSFW content: Pornography, sexually explicit material, sexual nudity, sexual exploitation, or non-consensual intimate imagery, including AI-generated material.
  • Violence and gore: Graphic injury, mutilation, torture, gore, or content that threatens, encourages, or glorifies violence or abuse.
  • Hate speech: Content that promotes hatred, dehumanization, discrimination, or violence against people based on characteristics such as race, ethnicity, nationality, religion, sex, gender identity, sexual orientation, or disability.
  • Child sexual abuse material (CSAM): Any sexual depiction, exploitation, or sexualization of a person under 18, including synthetic, fictional, or AI-generated depictions, or content facilitating child sexual abuse.
  • Deepfakes and impersonation: Deceptive deepfakes or impersonation of real people; using another person's likeness, face, identity, or voice without their consent; or falsely suggesting that someone participated in, endorsed, or said something. Consent does not permit content otherwise prohibited by these Terms.
  • Copyright and trademark infringement: Content that violates another party's copyright, trademark, or other intellectual property rights. You must hold the rights, permissions, or other lawful authorization needed to use submitted materials and generated outputs.

You also agree not to:

  • Use the service to harass, defraud, exploit, or harm others
  • Attempt to bypass any service limitations or security measures
  • Evade moderation filters or account restrictions, including by creating replacement accounts
  • Use our services for any illegal purposes
  • Reverse engineer or attempt to extract our AI models

5.1 Content Moderation

MimicPhoto uses automated content screening, including third-party moderation services, to assess text, images, and videos in supported processing flows. Depending on the tool, checks may occur on upload, before generation, or before an output is made available. Requests or outputs may be blocked when prohibited content is detected or a required moderation check cannot be completed.

We may also manually review reports, flagged content, and relevant account activity to investigate abuse and determine enforcement actions. Automated checks can make mistakes and do not detect every violation; a successful generation is not permission to use prohibited content. You remain responsible for complying with these Terms. Content processing and review are subject to our Privacy Policy.

5.2 User Reporting and Review Requests

To report violating generated content, misuse of your likeness, or intellectual property infringement, email hello@mimicphoto.com with the subject "Content report". Include the content URL or task ID, the suspected violation, and enough context for us to investigate. For rights-related reports, explain your relationship to the affected person or rights holder and provide supporting information where available. Do not send or attach CSAM; provide only identifying details such as the URL or task ID.

We review reports and may request additional information, restrict access to reported content during review, or take the actions described below. If you believe a moderation or account decision was mistaken, request a review at the same address and include the relevant account or task details and your explanation.

5.3 Enforcement Actions

Depending on the seriousness, recurrence, and circumstances of a violation, we may issue a warning, reject a request, block or remove violating content, restrict features, or suspend or terminate an account. Serious violations, including CSAM or exploitation, may result in immediate action without a prior warning. We may preserve relevant records and report suspected illegal activity to appropriate authorities when required by law. Account and credit consequences are explained in Section 11.

6. Content Rights

Regarding content generated through our services:

  • You retain rights to your original uploaded content
  • You grant us license to process and store your content
  • Generated content is provided for personal use
  • Commercial usage rights must be separately arranged

7. Service Limitations

  • Maximum file size: 50MB per upload
  • Supported file formats: JPG, PNG, MP4
  • Processing time may vary based on server load
  • Service availability subject to maintenance windows

8. Disclaimers

Our services are provided "as is" without warranties of any kind. We do not guarantee:

  • Uninterrupted service availability
  • Specific results from using our services
  • Perfect accuracy of AI-generated content
  • Compatibility with all devices or browsers

9. Limitation of Liability

MimicPhoto shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use or inability to use our services.

10. Changes to Terms

We reserve the right to modify these terms at any time. We will notify users of any material changes via email or through our website. Continued use of our services constitutes acceptance of modified terms.

11. Term, Suspension, and Termination

These Terms apply while you access or use MimicPhoto. If you breach these Terms, including the content standards in Section 5, we may suspend or terminate your account and access to the service, and remove or disable access to violating content. We may temporarily suspend access while investigating suspected violations and act immediately where necessary to prevent harm, address a serious breach, or comply with law.

During suspension, you may be unable to use your account or credits. If your account is terminated for a violation, unused credits may be forfeited without a refund to the extent permitted by applicable law. This does not limit any mandatory consumer rights or refund rights you have under applicable law. Termination does not authorize further use or distribution of prohibited content or remove obligations incurred before termination.
